Buffalo Gunman Sentenced After Attempting to Injure Victim in Shooting Incident

32-year-old Devante D. Henley was jailed for shooting at a car and barely missing a victim.

Buffalo, New York (WNY News Now) A Buffalo man who tried to gravely hurt a victim during a shooting incident was given a three-year sentence in state prison today. After entering a guilty plea to attempted assault and criminal possession of a firearm, Devante D. Henley, 32, was sentenced by Justice Debra Givens of the State Supreme Court.

Around 12:10 a.m. on December 8, 2023, the shooting occurred. Henley intended to seriously injure the victim when he fired several shots from an illegal firearm at a car close to Ship Canal Parkway and Tifft Street in Buffalo. The car suffered severe damage, estimated at $13,000, but the victim was unharmed.

After discharging the gun, Henley, who was in his own car when the shooting occurred, quickly left the area. Although the victim was unharmed, the shooting resulted in a traumatic event and significant financial loss. Later, Henley entered a guilty plea to two Class C violent felonies: one count of First Degree Attempted Assault and one count of Second Degree Criminal Possession of a Weapon. All of the charges against him related to the indictment were dropped when he entered a guilty plea.

Detectives Lon Folts, Robert LaRusch, Det/Sgt. John Losi, and Matt Krug worked diligently on the investigation, which was headed by the Buffalo Police Department Gun Violence Unit. The assistance given by victim advocate Clarissa Acosta, who collaborated with the impacted party, was also commended by the DA’s office.

Prosecution of the case was handled by Major Crimes Bureau Assistant District Attorney Ryan M. Flaherty.

Henley’s sentence is set at three years in jail with two years of post-release supervision.
