A man from Centre County filed a federal lawsuit on Tuesday against a nursing home, alleging that he was denied a job after disclosing his use of medical marijuana. Seth Unger, who resides in Centre County, has been prescribed medical marijuana for anxiety, according to his lawyers. The lawsuit contends that his anxiety disorder qualifies as a disability under the 1990 law that prohibits discrimination based on disability. Unger applied for a position as a nursing assistant student at Centre Care. During his January interview, he was informed that he would need to take a pre-employment drug test. According to his attorneys, his interview was terminated and his application was rejected after he disclosed his use of medical marijuana. Unger claims that this action constitutes discrimination under the Americans with Disabilities Act. Centre Care responded with a statement, saying, "Our commitment remains with our team members at Centre Care and our commitment to following our hiring policies. While our legal team handles this matter, we are unable to comment on specific issues pending litigation.
