Washington Although he asserted that the matter was not discussed, Justice Samuel Alito acknowledged on Wednesday that he received a call from Donald Trump the day before the president-elect requested that the Supreme Court postpone his impending sentencing.
In a statement, Alito stated that he met with William Levi, one of his former legal clerks, Tuesday afternoon after Levi “asked me to take a call from President-elect Trump regarding his qualifications to serve in a government position.”
“I agreed to discuss this matter with President-elect Trump, and he called me yesterday afternoon,” Alito stated in the statement, an account that ABC News broke first. “We did not discuss the emergency application he filed today, and indeed, I was not even aware at the time of our conversation that such an application would be filed.”
Before his sentencing hearing on Friday, Trump requested the Supreme Court on Wednesday morning to pause the court’s work in his hush money case.
Trump is already protected by presidential immunity, according to the president-elect’s attorneys, who argued in the filing that the high court should halt the New York proceedings “to prevent grave injustice and harm to the institution of the Presidency and the operations of the federal government.”
Alito stated that he and Trump “did not discuss any other matter that is pending or might in the future come before the Supreme Court or any past Supreme Court decisions involving the President-elect.”
A request for response Wednesday night was not immediately answered by a Trump spokesman.
When an upside-down American flag fluttered outside of Alito’s Virginia home last year, he came under fire. In the past, some Trump supporters who thought the 2020 election was rigged used the upside-down flag as a protest symbol.
In a letter to members of Congress, Alito claimed that he “had nothing whatsoever to do with the flying of that flag,” adding that he requested his wife, Martha-Ann Alito, to remove it as soon as he saw it, “but for several days, she refused.”
Several Democrats in Congress pushed Alito to step aside from Trump-related lawsuits following the event. Alito said no.
