Menendez brothers’ bid to be freed: Where does their resentencing effort stand?
Following the dismissal of Los Angeles County's chief prosecutor earlier this month, who suggested a fresh sentence that may allow the brothers' release, Erik and Lyle Menendez's attempts to shorten their life sentences without the possibility of parole are still in limbo.
However, a lawyer for the brothers told NBC News that those efforts will continue Monday when they appear for a status conference to decide whether to keep a Dec. 11 resentencing hearing scheduled.
Erik and Lyle will make a remote appearance from the San Diego prison where they are being detained, defense lawyer Mark Gerago told NBC Los Angeles.
The brothers were sentenced to 35 years in prison for the August 20, 1989, shotgun killings of their parents, Jos and Kitty Menendez, in their Beverly Hills residence.
